ArChat® — Refund Policy
This Refund Policy explains our rules regarding refunds, returns, chargebacks, and payment disputes for paid plans and subscriptions on ArChat. It forms part of our overall contractual framework and should be read together with our Terms and Conditions of Use and Privacy Policy. For an overview of all legal documents, see Terms and policies.
1. Scope
This Policy applies to all payments made for ArChat paid plans (Foundation, PRO, and any other paid subscriptions), including recurring billing processed through third-party payment processor(s) designated by ArChat from time to time (which may include, without limitation, processors such as Paddle where applicable).
2. General No-Refund Policy
ArChat operates on a strict no-refund policy for partially used subscription periods.
Except where required by mandatory applicable consumer protection laws or as part of a specific official promotion clearly stated by ArChat, we do not offer prorated refunds for any portion of a billing cycle that has already begun.
By subscribing to a paid plan, you acknowledge and accept that payments are non-refundable for the current billing period.
3. Cancellation and Future Renewals
You may cancel your subscription at any time through your account settings. Cancellation will prevent future automatic renewals and charges.
However, cancellation does not entitle you to a refund for the current billing cycle already paid. You will continue to have access to your paid features until the end of the current billing period (unless otherwise specified).
4. No Refunds for Completed Billing Cycles
Once a payment has been successfully processed and the corresponding billing cycle has started, that payment is final and non-refundable, except in cases where refund is mandated by applicable law.
5. Exceptions
Refunds may be granted only in the following cases:
- When explicitly required by mandatory consumer protection laws in your jurisdiction.
- When ArChat, at its sole discretion, decides to offer a refund as part of a specific promotional campaign or goodwill gesture (clearly communicated in advance).
- In exceptional circumstances, such as serious technical failures on our side that materially prevent you from using the Service for a significant portion of the billing period (evaluated case by case).
Any refund, if granted, will be issued to the original payment method and may take up to 10 business days to process, depending on the payment provider.
6. Payment Processing and Third-Party Providers
All payments are processed by external payment provider(s) designated by ArChat from time to time (which may include, without limitation, providers such as Paddle). ArChat does not store complete credit card information on its own systems.
We are not responsible for delays, rejections, currency conversions, or decisions made by the payment processor or your financial institution. Any refund will be handled according to the policies and timelines of the respective payment provider.
7. Chargebacks and Payment Disputes
If you initiate a chargeback, dispute, or reversal through your bank or payment provider, we reserve the right to:
- Defend the charge using all available evidence (usage logs, subscription records, communications, etc.).
- Immediately suspend or terminate your account and access to the Service until the dispute is resolved.
- Charge any fees or costs incurred due to the chargeback (including chargeback fees imposed by the payment processor), where permitted by law.
Repeated or abusive chargebacks may result in permanent account termination and blacklisting from future services.
8. Changes to Subscription Plans
Changing plans (upgrade or downgrade) does not automatically trigger a refund. Any credit or adjustment will be handled according to the logic of the current billing cycle and the specific plan change rules in effect at the time.
9. Relationship with Other Policies
This Refund Policy is complementary to our Terms and Conditions and the Subscription, Billing and Cancellation Policy. In case of any conflict, the Terms and Conditions shall prevail, unless a specific legal obligation requires otherwise.
10. Governing Law
This Refund Policy is governed by the laws of the Republic of Argentina. Any disputes arising from this Policy shall be subject to the jurisdiction of the competent courts of Mar del Plata, Province of Buenos Aires, Argentina, unless mandatory consumer laws in your country of residence provide otherwise.
11. Changes to this Policy
We may update this Refund Policy from time to time. Material changes will be notified through the Service or by email when possible. Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Policy.
